29 CFR 1926.201(a): Flaggers. Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers shall conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition), which are incorporated by reference in ��1926.200(g)(2). a) Asphalt Specialties Co., Inc. at 117th Ave. and Grant St., Northglenn, CO 80234: On or before August 4, 2016, the employer did not furnish a place of employment free from struck-by hazards in a construction work zone. The employer was repaving one lane of 117th Ave. with asphalt near the intersection with Grant Street. The flagger stepped into the intersection to direct an oncoming vehicle. An Asphalt Specialties truck, with its bed raised, pulled into the intersection, and ran over the flagger, resulting in lower body injuries. The employer designed and applied a Method of Handling Traffic (MHT) that did not take into account the extension of the work zone into the intersection. The MHT depicted a lane closure on a two lane street. The mixed use of the construction equipment and commercial traffic was not safely integrated at this intersection. This condition exposed the flagger to struck-by hazards.
