29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:     The employer is failing to provide adequate employee training on the recognition of hazards specific to the work employees are assigned to perform prior to exposing the employees to those hazards.  The most recent occurrence of this was found at the facility located at 2702 W. 11th Street, Kearney, NE where the employer has employees working on the construction of a new facility without having had adequate training.  Adequate training and instance of exposure include but are not limited to:   i.  Employees using an 8 foot fiberglass step ladder in a location where they can only reach while working blind overhead when they needed a 10 foot ladder so they could see into the box they were reaching into while they worked.    ii. Employees installing new wiring through existing conduit with live wiring already installed without considering the principles of Lockout/Tag Out by de-energizing the live wires prior to opening the junction box.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:    The employer is failing to protect employees from electrical hazards associated with employees working on live electrical wiring.  The most recent occurrence of this was found at the facility located at 2702 W. 11th Street, Kearney, NE where the employer has employees running new wiring through conduits with live wiring is already in use and has the employee opening junction boxes to connect wiring without de-energizing the circuit first, resulting in the employee being shocked when coming into contact with energized wiring within the box.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into pysical or electrical contact with the electric power circuit:    The employer is failing to protect employees from electrical hazards associated with employees installing new un-energized wiring through existing conduit with energized wiring.  The most recent occurrence of this was found at the facility located at 2702 W. 11th Street, Kearney, NE where the employer has employees running new wiring through conduits with live wiring is already in use without having inspected those boxes and connections to ensure that all live electrical wiring has been properly insulated and incidental contact with live wiring is not possible.  Instead the employer had the employee opening junction boxes to connect wiring without de-energizing the circuit first, resulting in the employee being shocked when coming into contact with energized wiring within the box.
