29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace: (a) On or about June 17, 2016 at Tell City Boat Works in the enclosed and confined spaces and on the exterior of the barges, the painters were spray painting Intertuf 262 Part A, Intertuf 262 Part B, and GTA220 Thinner. Riggers were using brushes to paint the barges. The employer had not identified or evaluated the respiratory hazards the painters and riggers were exposed to while painting the barge, exposing employees to potential inhalation hazards.

29 CFR 1910.134(d)(3)(iii)(B)(2): The employer did not implement a change schedule for respirators not equipped with an End of Service Life Indicator that would ensure cartridges were changed before the end of their service life. The employer had not described in their program the information and data relied upon for the change schedule: (a) On or about June 17, 2016 at Tell City Boat Works in the barge enclosed and confined spaces and on the exterior, the painters were spray painting Intertuf 262 Part A, Intertuf 262 Part B, and GTA220 Thinner and riggers were using brushes to paint. All three chemicals work flammable and toxic/poisonous. The employer had provided half mask and full face respirators with organic vapor cartridges. No changeout schedule was provided for the cartridges at this location, exposing employees to potential inhalation hazards.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used and at least annually thereafter: (a) On or about June 17, 2016, the employer had not retested employees who were using different respirators than what they were originally fit tested wearing. Employees had been fit tested with a 7600 or 7700 North, but were wearing a 7700 North and a 3M full face respirator with cartridges. (b) On or about June 17, 2016, the employer had not retested employees who were using different respirators than what they were originally fit tested wearing. One employee had only been fit tested with a 7600 North, but was wearing a 7700 North and a full face 3M respirator with cartridges.. One employee stated that they had not been fit tested for 3 years.
