29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about August 11th, 2016 for an employee exposed to cave in hazards while installing a water line in an unprotected trench approximately 10 feet deep approximately three miles west of Stanley, North Dakota. NOTE: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1035187, Citation 1, Item 2A, and was affirmed as a final order on August 3rd, 2015, with respect to a workplace located at 10372 Second Street SW, Killdeer, North Dakota.

Note: The company was previously cited for a violation of this Occupational Safety and Health standard, more specifically failure to provide protective systems while working in an excavation or its equivalent standard which was contained in OSHA Inspection Number 1035187, Citation 1, Item 2B, and was affirmed as a final order on August 3rd, 2015, with respect to a workplace located at 10372 Second Street SW, Killdeer, North Dakota.
