29 CFR 1910.1200(h)(3)(iv): Employees were not provided effective information and training on the details of the hazard communication program developed by the employer, to include an explanation of the labels; the safety data sheet, including the information contained therein, and how employee could obtain and use the appropriate hazard information: a) U.S. Concrete Inc. dba Ferrara Bros. LLC/Staten Island, NY- Chelsea Plant Area: The employer did not ensure that employees were provided with effective information and training on the details of the hazard communication program developed by the employer. Employees were not familiar with the new label elements to include the pictograms, the information contained on the Safety Data Sheets (SDS), the location of the SDS and the location of the hazard communication program. Employees are exposed to hazardous chemicals on daily basis including but not limited to cement dust, concrete additives, oils and lubricants. Condition observed on or about August 15, 2016.

Employer had Safety Data Sheets and an outdated Material Safety Data Sheets (MSDS) for the following chemicals: a) MasterGlenium 7500 manufactured/supplied by BASF b) PB Blaster (6503 Penetrating Catalyst) manufactured/supplied by The Blaster Corporation c) MasterLife SRA 20 manufactured by BASF Corporation d) Imperial Red-Tac No.2 manufactured/supplied by Imperial Sales Company e) Tornado manufactured/supplied by Power Kleen Corporation f) Slag (NewCem) manufactured/supplied by Lafarge North America Inc. Condition observed on or about August 15, 2016.
