OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards while working under an automotive lift which had a defective or overridden safety features. Service Bay, 44 Mulberry Street, West Springfield, MA; Employees were required to work under an extended automotive lift which had defective and\or overridden safety devices. The Red CL Challenger Model E12 SN#150600000125828 automotive lift had a broken safety release cable, overridden constant pressure switch which was replaced by a single pole light switch and a safety latch which was pried and held open by a 4 inch paint scraper. Among other methods, one feasible and acceptable means of abatement includes, but is not limited to, following the American National Standards Institute Automotive Lift Institute Standard for Automotive Lifts- ANSIALI ALOIM-2008 Safety Requirements for Operation, including but not limited to: (a) Paragraph 4.2 Operation- Ensure operators are trained in the proper methods to inspect the lifts safely. (b) Section 8, Replacement Parts- Safety latches that have been removed are replaced with parts approved by the original equipment manufacturer or with meeting original manufacturer specifications. (c) Paragraph 6.2 Repair maintenance- Employer or owner shall perform repair maintenance whenever called for by the lift operator, qualified lift inspector or planned maintenance technician.

29 CFR 1910.1200(f)(5)(i): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein: 44 Mulberry Street, West Springfield, MA: On or about August 15, 2016 employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identify of the hazardous chemicals contained therein. (a) Jug, Plastic, on oil drum. A yellow oil dispensing jug was found on top of the bulk container, containing hazardous chemicals which was not labeled with its contents. (b) Jug, plastic, on oil drum. A semi-clear 1 gallon jug was found uncapped and unlabeled as to the contents which were contained therein. (c) Drum, plastic, (55 gal est.). Two large blue plastic drums were located on the shop floor near the recycled oil tank which were not labeled at its contents therein. (d) Bottle plastic, brake drainer. small plastic bottle with tubing used to drain brakes was not labeled as to the contents located therein.
