OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards while working at approximately 12 feet off the floor: a) On or about 08/09/2016 - Transformer vault #1, an employee standing on the top of a transformer removing a vent plug with a crescent wrench was not protected from falls of approximately 12 feet.

29 CFR 1910.333(a)(1): The employer failed to ensure that live parts were deenergized before employees began to work on or near them: a) On or about 08/09/2016 - Transformer vault #1, an unqualified employee climbed up on a ladder to gain access to a live 13,800 volt transformer to remove a vent plug. The employee walked across the transformer, removed the vent plug, placed the plug and wrench on the transformer, and then turned and walked back to the ladder, got on the ladder where an arch flash occurred resulting in 1st, 2nd, and 3rd degree burns over approximately 17% of the body to the left arm, shoulder, chest, and back, lacerations to the head and back.
