29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) Manhole #2 - One or about June 22, 2016, employees were installing a concrete manhole structure in a 14 foot deep excavation where the trench shield was situated 4 feet above the bottom of the excavation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations were not in written form at the jobsite during construction of the protective system and thereafter until the protective system was no longer utilized: a) Manhole #2 - On or about June 22, 2016, the employer did not have the tabulated data for a trench shield available on the project during excavation operations where the shield was used to protect workers in a 14 foot deep excavation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of the support system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the trench shield: a) Manhole #2 - On or about June 22, 2016, during a manhole structure installation operation, laborers were exposed to a cave-in hazard from a trench shield which had been placed in a 14 foot deep excavation and whose bottom was located 4 feet above the base of the excavation. No abatement certification or documentation required for this item.
