29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Rosettes on the support posts were used as a means of access. (a) Hanover House, Back side system scaffold: On or about August 17, 2016, and at times prior, the employer exposed employees to fall hazards of approximately 9-feet, 1-inch to the lower concrete surface, in that a ladder or other safe means of access was not provided to the scaffold platform as employees climbed the rosettes and support poles to access the mid level scaffold and ground levels.

29 CFR 1926.451(f)(15)(i): A ladder placed against a structure which was not part of the scaffold was not secured against the sideways thrust exerted by the ladder: (a) Hanover House, Back side system scaffold: On or about August 17, 2016, and at times prior, the employer used an extension ladder on top of a system scaffold which was placed against a structure which exposed employees to fall hazards of approximately 11-feet, 9-inches to the lower level, in that the ladder wasn't placed on the scaffold platform directly or secured to prevent movement during use.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Hanover House on Back side: On August 17, 2016, and at time prior, the employer exposed employees to all hazards of 20 feet 10 inches, for the working platform on the overhead platform, in that a fall protection system was not provided to employees while dismantling equipment and using the platform as a walking working surface.
