29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): The employer is failing to ensure that proper forklift training is provided to employees prior to utilizing forklifts. The driver stated that he had only received basic forklift training. The driver was using the forklift and a self-erected scaffold to elevate a co-worker for fascia installation. This most recently occurred on August 16, 2016 on the jobsite located at 48th and Cornhusker St, Lincoln, NE 68502.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: The employer is failing to ensure that guardrails are utilized on scaffolds that exceed heights of 10 feet. The scaffold was attached to the forklift and elevated to install fascia on the side of the building. The scaffold was raised to an approximate height between 10 and 16 feet. This most recently occurred on August 16, 2016 on the jobsite located at 48th and Cornhusker St, Lincoln, NE 68502.
