29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:     (a)  J&S Drywall Specialties, Inc., 500 16th Street, Denver, CO:  On or about August 16th, 2016, the employer did not ensure a "competent" person made frequent inspections of the worksite to ensure the installation of a complete guardrail system to minimize falling from the temporary elevated plywood scaffold platform near the southeast corner of the building on the second floor. The guardrails were missing midrails on the south and east sides of the plywood scaffold platform to prevent falls to the lower level. Condition exposed employees working on the plywood scaffold platform to a fall hazard of approximately 12 feet.     (b)  On or about August 16th, 2016, the employer did not ensure a "competent" person made frequent inspections of the jobsite to ensure the installation of toeboards along the perimeter of the temporary elevated plywood scaffold platform to prevent hand tools, debris, and other small objects from falling to the lower level. Condition exposed employees working on the first floor to struck by hazards.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.    Abatement Note:  Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet above the lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   (a)  J&S Drywall Specialties, Inc., 500 16th Street, Denver, CO:  On or about August 16, 2016, the employer did not ensure the installation of midrails to guard against falling from the temporary elevated plywood scaffold platform near the southeast corner of the building on the second floor. This condition exposed employees to a fall hazard of approximately 12 feet.   Abatement Note:  Abatement certification is not required for this item.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects:    (a)  J&S Drywall Specialties, Inc., 500 16th Street, Denver, CO: On or about August 16th, 2016, the employer did not ensure the installation of toeboards around the perimeter of the temporary elevated plywood scaffold platform near the southeast corner of the building on the second floor.  This condition exposed an employee working on the 1st floor to a struck by hazard from falling tools, debris, or other small objects.   Abatement Note:  Abatement certification is not required for this item.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):   (a)  J&S Drywall Specialties, Inc., 500 16th Street, Denver, CO:  On and prior to August 16th, 2016, the employer did not ensure employees potentially exposed to fall hazards were trained by a competent person to recognize and abate fall hazards.   Abatement Note:  Abatement certification is not required for this item.   Abatement Note:  The competent person must be qualified in the following areas;  1926.503(a)(2)(i)  The nature of fall hazards in the work area;  1926.503(a)(2)(ii)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  1926.503(a)(2)(iii)  The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  1926.503(a)(2)(iv)  The role of each employee in the safety monitoring system when this system is used;  1926.503(a)(2)(v)  The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;  1926.503(a)(2)(vi)  The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and  1926.503(a)(2)(vii)  The role of employees in fall protection plans;  1926.503(a)(2)(viii)  The standards contained in this subpart.
