29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.  a. On or before August 16, 2016 where employees were replacing metal roofing, the employees were not protected from falls, thereby exposing the employees to a 18 feet, 3 inch fall hazard, from which an employee had fallen on August 8, 2016 resulting in serious injuries requiring hospitalization.

29 CFR 1926.761(b): Fall hazard training. The employer shall train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program.  a. On or before August 16, 2016 where employees were replacing metal roofing, the employer failed to institute a fall hazard training program and did not ensure employees participated in the program.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a. On or after August 8, 2016, where an employee was hospitalized due to a work related accident, the employer failed to report the in-patient hospitalization.
