29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a)  At Pump House Location:  On or about August 22, 2016 and at times prior; the employer failed to ensure employees walking on a support beam had fall protection while attaching the cranes sling to the I-Beam exposing his employees to a fall hazard of 15 feet 1 inch to the ground and exposed rebar below.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:  a)  At Pump House Location:  On or about August 22, 2016 and at times prior; the employer failed to ensure the coffer dam walls located around the pump house being used as guardrails were the proper height of 42 inches as per the standard exposing his employees to a fall hazard of 18 feet to the ground below.  The height of the wall was measured at 35 inches.

29 CFR 1926.502(d)(5): Snaphooks shall be sized to be compatible with the member to which they are connected to prevent unintentional disengagement of the snaphook by depression of the snaphook keeper by the connected member, or shall be a locking type snaphook designed and used to prevent disengagement of the snaphook by the contact of the snaphook keeper by the connected member:   a)  At Pump House Location:  On or about August 22, 2016 and at times prior; the employer failed to provide his employees with adequate snap hooks on their lanyards that would properly connect to anchor points used by employees exposing his employees to a fall hazard of up to 18 feet to the ground below.  Employees were setting their snaphook on the hole  not allowing the snaphook to close and lock.  This would allow the snap hook to be easily knocked off without the employees knowledge.

29 CFR 1926.502(d)(6)(v): A snaphook not of the locking type was engaged (i) directly to webbing, rope or wire rope; (ii) to each other (iii) to a Dee-ring to which another snaphook or other connector is attached;(iv) to a horizontal lifeline; or (v) to any object which is incompatibly shaped or dimensioned in relation to the snaphook such that unintentional disengagement could occur by the connected object being able to depress the snaphook keeper and release itself.   a)  At Pump House Location:  On or about August 22, 2016 and at times prior; the employer allowed his employees to set his snaphook from his Personal Fall Arrest System on the holes in the coffer damn walls which would not allow the snaphooks to lock and could easily detach from the wall exposing the employees to a fall hazard of up to 18 feet to the ground below.  The holes cut into the coffer dam wall were not large enough for the employee to run their snaphook and to tie off back to itself.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:  a)  At Pump House Location:  On or about August 22, 2016 and at times prior; the employer failed to guard exposed rebar below workers cutting out support beams exposing them to an impalement hazard.  The site superintendent was standing on a I-beam when it broke away from the wall causing the superintendent to fall and he became impaled by the rebar.

Jordan Construction: On or about August 22, 2016 and at times prior; the employer exposed employees to chemical hazards to include but not limited to diesel fuel, oxygen and acetylene in that employees were not provided the new information and training on the UN Global Harmonized System (GHS) to include Safety Data Sheets (SDS).
