(a) Excavation Site - On or about 12 August, 2016, an employee was observed not wearing personal protective equipment, a seatbelt, while operating the CAT front loader. (b) Excavation Site - On or about 12 August, 2016, an employee was observed not wearing personal protective equipment, a seatbelt, while operating the Gradall excavator.

29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; without a reverse signal alarm distinguishable from the surrounding noise level or an employee who signaled that it was safe to do so. (a) Excavation Site - On or about 12 August, 2016, an employee was observed operating the Caterpillar front loader in reverse with no audible alarm or spotter.
