OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed fall hazards: a) On or about 8/24/2016, throughout the orchard: the employer allowed workers to use orchard tripod ladders inadequately, while exposed to fall hazards. a) On or about 8/24/2016, throughout the orchard: the employer did not ensure workers received sufficient ladder use training to avoid fall hazards. Amongst other feasible means of abatement: Ensure laborers position ladders properly for use and workers are thoroughly and continuously trained in correct and safe use of ladders, to comply with the American National Standard (ANSI A14.2) for Ladders - Portable Metal - Safety Requirements.
