29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  a)  On or about August 25, 2016 and at times prior to, the employer did not ensure that employees who operated Komatsu-25 forklift trucks moving pallets in the warehouse, had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace, exposing employees to struck-by and crush hazards.

The employer had not developed a written hazard communication program for the chemicals used by employees such as but not limited to liquid propane gas.

29 CFR 1910.157(c)(4): Portable fire extinguisher was not kept in the designated place:  a)  On or about August 25, 2016 and at times prior to, a portable fire extinguisher was not mounted and maintained in a fully charged and operable condition on a Komasu-25 forklift truck, so that it was readily accessible to employees in case of fire emergency, exposing employees to possible injuries.  Employees operate the forklift to move pallets in the warehouse.
