29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30µg/m3) calculated as an 8-hour time-weighted average (TWA):    a) On or about August 25, 2016, at a worksite located at 3743 Main Street, Kansas City, Missouri, the employer failed to initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air calculated as an 8-hour time-weighted average (TWA). Employees were conducting manual scraping/sanding of surfaces where lead was present. Analysis of a 34.31 mg bulk sample of paint and wood chips collected at the worksite revealed that the sample was composed of approximately 6.29% lead.

29 CFR 1926.62(d)(2)(v): Until the employer performs an employee exposure assessment as required under paragraph (d) of this section and determines actual employee exposure, the employer must provide to employees performing the tasks described in paragraphs (d)(2)(i), (d)(2)(ii), (d)(2)(iii) and (d)(2)(iv) of this section with interim protection as follows: [A] Appropriate respiratory protection in accordance with paragraph (f) of this section. [B] Appropriate personal protective clothing and equipment in accordance with paragraph (g) of this section. [C] Change areas in accordance with paragraph (i)(2) of this section. [D] Hand washing facilities in accordance with paragraph (i)(5) of this section. [E] Biological monitoring in accordance with paragraph (j)(1)(i) of this section, to consist of blood sampling and analysis for lead and zinc protoporphyrin levels. [F] Training as required under paragraph (l)(1)(i) of this section regarding 29 CFR 1926.59 Hazard Communication; training as required under paragraph (1)(2)(iii) of this section, regarding use of respirators; and training in accordance with 29 CFR 1926.21, Safety training and education.    a) On or about August 25, 2016, at a worksite located at 3743 Main Street, Kansas City, Missouri, the employer failed to provide employees with interim protection as described in 29 CFR 1926.62(d)(2)(v)[A]-[D], including but not limited appropriate personal protective clothing and equipment, hand washing facilities, and training in hazard communication and use of respirators. Employees were conducting manual scraping/sanding of surfaces where lead was present. Analysis of a 34.31 mg bulk sample of paint and wood chips collected at the worksite revealed that the sample was composed of approximately 6.29% lead.

29 CFR 1926.62(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead:    a) On or about August 25, 2016, and dates prior to and following, at a worksite located at 3743 Main Street, Kansas City, Missouri, the employer failed to maintain all surfaces as free as practicable of accumulations of lead. Employees were exposed to accumulations of lead on surfaces at a worksite where manual scraping/sanding and manual demolition of structures was occurring.    1) A 100 square centimeter wipe sample was taken on the newly painted exterior window sill at the South end of the porch. Lead was present at 3132.00 micrograms.    2) A 100 square centimeter wipe sample was taken on an exterior window sill on the North side of the structure from which old paint was scraped/removed. Lead was present at 236.50 micrograms.    3) A 100 square centimeter wipe sample was taken on the newly painted exterior window sill at the North end of the porch. Lead was present at 6008.00 micrograms.

29 CFR 1926.62(l)(1)(i): Hazard communication. The employer shall include lead in the program established to comply with the Hazard Communication Standard (HCS) (� 1910.1200). The employer shall ensure that each employee has access to labels on containers of lead and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (l) of this section. The employer shall ensure that at least the following hazards are addressed: [A] Reproductive/developmental toxicity; [B] Central nervous system effects; [C] Kidney effects; [D] Blood effects; [E] Acute toxicity effects.    a) On or about August 25, 2016, and dates prior to and following, at a worksite located at 3743 Main Street, Kansas City, Missouri, the employer failed to include lead in the program established to comply with the Hazard Communication Standard (HCS) (� 1910.1200). The employer failed to ensure that employees were trained in accordance with the provisions of HCS and paragraph (l) of this section. Employees were conducting manual scraping/sanding of surfaces where lead was present. Analysis of a 34.31 mg bulk sample of paint and wood chips collected at the worksite revealed that the sample was composed of approximately 6.29% lead.
