29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: a) At Pump House Location: On or about August 22, 2016 and at times prior; the controlling employer failed to ensure the coffer dam walls located around the pump house excavation being used guardrails were the proper height of 42 inches as per the standards exposing his employees to a fall hazard of 18 feet to the ground below. The height of the wall was measured at 35 inches.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: a) At Pump House Location: On or about August 22, 2016 and at times prior; the controlling employer failed to guard exposed rebar below workers cutting out support beams exposing them to an impalement hazard. The site superintendent was standing on a I-beam when it broke away from the wall causing the superintendent to fall and he became impaled by the rebar.
