OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees who unload trailers with powered industrial vehicles were exposed to fall, crush and struck by hazards due to the trailers not remaining stationary at loading docks while powered industrial vehicles entered and exited from the trailers. On or about August 26, 2016, an employee operating a powered industrial vehicle was traversing from a loading dock into a trailer which was positioned at dock bay #11. The employee was inside the trailer loading it when the trailer started to pull away from the dock with the employee inside. This action cause the employee and his powered industrial vehicle to roll out of the trailer and land onto the ground, upright, approximately 4 feet down.
