29 CFR 1926.1101(k)(1)(ii): The employer did not include asbestos in the program established to comply with the Hazard Communication Standard (HCS) 29 CFR 1910.1200, did not ensure that each employee had access to labels on containers of asbestos and safety data sheets and did not ensure hazard communication training on asbestos in accordance with the provisions of the Hazard Communication Standard 29 CFR 1910.1200 as well as paragraphs (k)(9) and (10) of this section:    a) Worksite at 65 Pennington St., Newark, NJ    The employer did not include asbestos in a hazard communication program to ensure that workers were trained in the hazards of asbestos.  Employees performing demolition in a third floor bathroom were exposed to pipe insulation containing 70% chrysotile asbestos.    Condition observed on or about 7/12/16.

29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1):    a) Worksite at 65 Pennington St., Newark, NJ    The employer did not identify the presence and location of presumed asbestos containing material before employees demolished a partition wall in a third floor bathroom.  Two samples of pipe insulation found in the debris contained 65 and 70 percent asbestos.    Condition observed on or about 7/12/16.

29 CFR 1926.1101(k)(3)(ii)(B): The employer did not inform employees who performed work under 29 CFR 1926.1101 of the location and quantity of asbestos containing material and/or presumed asbestos containing material present in the area:    a) Worksite at 65 Pennington St., Newark, NJ    The employer did not inform employees renovating bathrooms that any insulation or encapsulation found on piping within the walls should be presumed to contain asbestos.  Pieces of pipe insulation found in the third floor bathroom contained 65-70 percent asbestos.    Violation occurred on or about 7/15/16.

29 CFR 1910.134(k)(6) as referenced by 29 CFR 1926.103: The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:    a)  Worksite at 65 Pennington St., Newark, NJ    Employees were not given basic information on respirator usage, maintenance, storage, and the respirator's physiological effects when worn.  Employees voluntary used filtering facepiece respirators while grinding cement flooring and demolishing bathroom walls during a renovation of a five story residential building.    Violation occurred on or about 7/12/16.
