29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On or about August 26, 2016, at the worksite located at 57th Street and Greenfield Avenue, West Allis, WI, employees did not have lateral access to a means of egress within 25 feet. Employees were working on the north end of the trench and accessed the trench by an extension ladder on the south end of the trench, located approximately 50 feet away.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) On or about August 26, 2016, at the worksite located at 57th Street and Greenfield Avenue, West Allis, WI, employees were exposed to cave-in while conducting pipe connections in an inadequately protected trench. The employer did not conduct a daily trench inspection before starting work and during excavation activities to identify changing soil conditions, and to determine that the protective system in place is adequate for the conditions present and installed correctly.
