OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that powered industrial truck (forklift) operators were exposed to crushing injuries.    a) Worksite, 181 Pringle Street, Kingston, PA - Employees operated the employer numbered #42 Komatsu Forklift Model FG40ZT2-8 (Serial No. 131694A) without wearing the manufacturer installed operator restraint system (seat belt) which exposed employees to crushed-by hazards in the event of an accident, as observed on or about August 31, 2016.    b) Worksite, 181 Pringle Street, Kingston, PA - Employees operated the employer numbered #43 Komatsu Forklift Model FG40ZT2-8 (Serial No. 132394) without wearing the manufacturer installed operator restraint system (seat belt) which exposed employees to crushed-by hazards in the event of an accident, as observed on or about August 31, 2016.    c) Worksite, 181 Pringle Street, Kingston, PA - Employees operated the employer numbered #44 Komatsu Forklift Model FG40ZT2-8 (Serial No. 135503A)  without wearing the manufacturer installed operator restraint system (seat belt) which exposed employees to crushed-by hazards in the event of an accident, as observed on or about August 31, 2016.    d) Worksite, 181 Pringle Street, Kingston, PA - Employees operated the employer numbered #21 Hyster Lift Truck Model 150 (Serial No. D006D06586F) without the manufacturer retrofit operator restraint system (seat belt) which exposed employees to crushed-by hazards in the event of an accident, as observed on or about August 31, 2016.    e) Worksite, 181 Pringle Street, Kingston, PA - Employees operated the employer numbered #25 Hyster Lift Truck Model 155XL (Serial No. F006A03628K)without the manufacturer retrofit operator restraint system (seat belt) which exposed employees to crushed-by hazards in the event of an accident, as observed on or about August 31, 2016.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation.

29 CFR 1910.305(g)(1)(iv)(B): Flexible cords and cables were used where run through holes in walls, ceilings, or floors:    a) Storage Shed/Storage Warehouse, 181 Pringle Street, Kingston, PA - A flexible cable run through a hole in the southeast metal wall of the Storage Warehouse was disconnected/connected to an energized electrical outlet by employees on a daily basis to operate a light in the Storage Shed exposing employees to a contact with electrical current hazard, on or about August 31, 2016.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:    a) Worksite, 181 Pringle Street, Kingston, PA - Employees operated the employer numbered #42 Komatsu Forklift Model FG40ZT2-8 (Serial No. 131694A) equipped with a non-functional reverse light and a non-functional back-up alarm which exposed employees to crushed-by hazards while the powered industrial truck operated in reverse, as observed on or about August 31, 2016.    c) Worksite, 181 Pringle Street, Kingston, PA - Employees operated the employer numbered #24 Hyster Lift Truck Model 110E (Serial No. D005D03436G) equipped with a non-functional horn which exposed employees to crushed-by hazards while the powered industrial truck was operated in reverse or approaching blind spots, as observed on or about August 31, 2016.    c) Worksite, 181 Pringle Street, Kingston, PA - Employees operated the employer numbered #25 Hyster Lift Truck Model 155XL (Serial No. F006A03628K) equipped with non-functional reverse lights which exposed employees to crushed-by hazards while the powered industrial truck was operated in reverse, as observed on or about August 31, 2016.    In accordance with 29 CFR 1903.19(c) and (d), abatement certification and documentation is required for this violation.
