OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:    (a) Warehouse: On or about March 01, 2016 and at times prior, employees were exposed to a struck by hazards while working in and around damaged storage racks.                                                                                          (b) Warehouse: On or about March 01, 2016 and at times prior, and at times prior, employees were exposed to a struck by hazards while working in and around storage racks that were not securely fastened to the floor.                                                                         (c) Warehouse: On or about March 01, 2016 and at times prior, employees were exposed to a struck by hazards while working in and around storage racks that did not display a plaque designating load sizes.                                                                                                                                                      (d) Warehouse: On or about March 01, 2016 and at times prior, and at times prior, employees were exposed to a struck by hazards while working in and around storage racks that were not properly guarded against minor impacts.        Kalmont Distributors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 1129957, citation number 01, item number 001 and was affirmed as a final order on June 22, 2016, with respect to a workplace located at 2549 Highway 2 East, Kalispell, Montana 59901.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:      (a) Shop: On or about March 01, 2016 and at times prior, employees were exposed to respiratory hazards while using an N-95 filtering face piece respirator, supplied by the employer, during welding operations. The employer failed to identify and evaluate a reasonable estimate of employee exposures and the contaminant's chemical state and physical form.            Kalmont Distributors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(d)(1)(iii), which was contained in OSHA inspection number 1129957, citation number 01, item number 003 and was affirmed as a final order on June 22, 2016, with respect to a workplace located at 2549 Highway 2 East, Kalispell, Montana 59901.
