Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards while handling a flammable solid material: a) 2ND Floor Reactor (R- 102) Area - On/or about 08/29/2016, employees were removing a flammable solid material from the reactor through PVC hoses into a 55 gallon metal drum using a vacuum truck, when a fire occurred inside the drum. The employer did not ensure that potential ignition sources, such as the generation of static electricity, were adequately controlled. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000 IN ACCORDANCE WITH 29 CFR 1903.19.
