OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting caught-in or between a tipping forklift and the ground:  a) 379 S. Albemarle Street, York PA - On or about September 2, 2016, employees were observed operating Unicarriers forklifts without the use of the manufactured installed seatbelt, exposing them to crushing injuries associated with tipover hazards.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    a) 379 S. Albemarle Street, York PA - On or about September 2, 2016, employees were observed operating forklifts to move material around the yard and load/unload trailers and had not completed employer training and evaluation, exposing employees to struck-by hazards. Albemarle Street, York PA; Chop Saw - On or about September 2, 2016, a disconnect switch was blocked by two OSB plywood sheets.    b) 370 S. Albemarle Street, York PA; Trim Saw - On or about September 2, 2016, a disconnect switch was blocked by two OSB plywood sheets.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.334(a)(2)(i): Portable cord and plug connected equipment and flexible cord sets (extension cords) were not visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket):  a) 379 S. Albemarle Street, York PA - On or about September 2, 2016, the employer did not ensure that the cord on a portable hand lamp was examined for damage. The outer jacket near the handle was damaged exposing the inner insulation.  No abatement certification or documentation required.
