29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) On August 16, 2016 employees working in the yard and inside of a metal container were not provided and used reflective vests and/or high visibility clothing to alert the crane operator of their present in that an employee inside of a metal container was caught in the crane's grabber arms.

29 CFR 1910.145(c)(1)(ii): All employees shall be instructed that danger signs indicate immediate danger and that special precautions are necessary. a) On August 16, 2016 danger signs were not displayed in the yard where metal material was being loaded or moved in the yard, to warn the employees of caught in and struck by hazards from the moving grapple crane.
