OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to the employee, in that employee were exposed to the hazard of being struck and/or hit by falling motor vehicles from the automotive lifts:    ESTABLISHMENT:  The employer did not ensure that the employee, operating the Avco and Joyce auto lifts, were protected at all times from the hazards of being struck and/or hit by falling objects/vehicles from the lifts by the utilizing proper and appropriate means.      On/or about August 30, 2016; a vehicle that was hoisted up with a Avco lift was displaced and fell while an employee was performing repair and service work.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  WORKSHOP:  The employer had not established and implemented a written hazard communication program, including the Globalized Harmonized System, where employee was required to work with chemicals, such as (but not limited to) 134 Freon, motor oil, brake fluid, diesel engine oil, and windshield washer fluid.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  WORKSHOP:  The employee, who was required to work with chemicals, such as (but not limited to) 134 freon, motor oil, brake fluid, diesel engine oil, and windshield washer fluid was not provided with training and information in the chemical hazard communications, including the Globalized Harmonized Systems.
