29 CFR 1926.651(e): Employees were not prohibited from being underneath loads handled by lifting or digging equipment: Wittig Construction, 133 Water Street, Fitchburg, Massachusetts; Employees were exposed to struck by hazards while fill was being dumped from an excavator in the vicinity they were working in. The rotation of the equipment required the bucket to move over the employees to drop the material in the desired location.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. Wittig Construction, 133 Water Street, Fitchburg, Massachusetts; Employees were exposed to struck by hazards from spoil piles and materials that were less than 2 feet from the edge of a trench that was approximately 6 feet deep. a. The spoil piles were directly along side of the trench and were sloping into the trench. b. The excavator used by the owner was up to the edge of the trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: Wittig Construction, 133 Water Street, Fitchburg, Massachusetts; Two employees were working in a trench that was approximately 6 feet deep laying sewer pipe. The trench was not appropriately benched nor did it have other protection to protect the employees from cave-ins.
