29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein:    (a)  On or about September 6, 2016, and at times prior, the employer did not ensure that containers of hazardous chemicals had labels to inform employees about hazards of the chemicals in the containers.  They were not marked with a label from the manufacturer or distributor that is compliant with 29 CFR 191.1200(f)(1)(i)-(vi), or product identifier and words, pictures, symbols or a combination there of to provide employees information about the physical and health hazards of the hazardous chemicals.      Hazardous chemicals in the inadequately labeled containers that employees worked with include, but are not limited to, antifreeze in the maintenance shop (skin irritation, drying and defatting; organ damage; fetal damage; nausea and vomiting; respiratory tract irritation), used motor oil outside the maintenance shop (skin and eye irritation; asthma; respiratory tract irritation; central nervous system depression; damage to kidneys and lungs; fetal damage), and diesel fuel at the landfill site (cancer; chemical pneumonitis; pulmonary edema/hemorrhage; skin defatting and drying). 29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):    (a)  On or about September 6, 2016, and at times prior, safety data sheets were only available to employees in their work area by calling one of two employees at a different site and requesting the safety data sheet (SDS) be emailed.  On the day of the inspection SDSs were not readily accessible because this process took in excess of 35 minutes for the employee to receive the requested SDS.  Further, no back up process is in place if the two employees who have accesses to the SDSs are unavailable to find and email them when a request is made.      Hazardous chemicals to which employees are exposed include but are not limited to antifreeze (skin irritation, drying and defatting; organ damage; fetal damage; nausea and vomiting; respiratory tract irritation), used motor oil (skin and eye irritation; asthma; respiratory tract irritation; central nervous system depression; damage to kidneys and lungs; fetal damage), and diesel fuel (cancer; chemical pneumonitis; pulmonary edema/hemorrhage; skin defatting and drying). 29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet:  (a)  On or about September 6, 2016, and at times prior, the employer did not maintain a current list of the chemicals known to be in use at the site.  The identified deficiencies include:  (1)  hazardous chemicals missing from the list were at least, but not limited to, Castrol Radicool SF Premix Coolant and antifreeze, and Calumet Ultra Low Sulfur Diesel. (2)  information about the of hazardous chemicals known to be present did not include product identifiers to enable accurate cross-referencing to each chemical's safety data sheet.
