OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from struck-by hazards:    At the workplace located at 12356 Ballpark Way, Papillion, NE 68046 the employer is failing to protect employees from struck-by, caught between, and roll-over hazards associated with the operation of side by side passenger off-road utility vehicles.  On or about August 11, 2016 and at times prior the employer did not take necessary precautions to ensure that employees are protected while riding as a passengers in the cargo bed of the Kawasaki Mule Pro-FX, the Kawasaki Mule Pro-FXT, and the Kawasaki TERYX4 LE utility vehicles .      Amongst other means, feasible means of abatement include but are not limited to adhering by the vehicle manufacturers warnings and directions printed in the operator's manual which state the following:    1.  This vehicle is not designed to carry passengers in the cargo bed.  Installing additional passenger seating or carrying passengers in the cargo bed can cause changes in vehicle handling.      2.  WARNING Passengers riding in the cargo bed can be tossed about or even thrown out causing serious injury or death.  Do not install seating or carry passengers in the cargo bed.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    In the workplace located at 12356 Ballpark Way, Papillion, NE 68046 the employer is failing to protect employees from chemical hazards including but not limited to eye, skin and respiratory hazards while using chemicals such as Karcher concentrated power washer cleaning fluid and degreaser, turf fertilizers, herbicides and fungicides in that; a written hazard communication program has not been developed and implemented to ensure employees are provided with the necessary information on how to safely handle and use hazardous chemicals.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.    The employer has failed to report an in-patient hospitalization to OSHA within 24 hours.  This most recent occurrence of this took place at the facility located at 12356 Ballpark Way, Papillion, NE 68046 where on August 11, 2016 the employer had an employee thrown off of a Kawasaki Mule side by side passenger utility vehicle after striking their head on an overhead bridge.  The employee was taken to a local hospital where the employee was admitted and treated for head and spinal trauma.  The employer did not report the incident to OSHA until August 26, 2016.
