29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 09/06/16, in a trench/excavation where a 10 in. water line was being installed on the south side of the street in front of 964 Kenmore Ave., Buffalo, NY: One employee was standing in an unprotected area of the trench, under a moving arm of an excavator, just on the west side of the duct bank. A second employee was crouching down/kneeling in the trench with his neck and entire torso outside the area of a trench box located in the east end of the trench. The employee then stood up in the trench, entirely outside of the trench box, and was grasping a cable attached to the excavator bucket. The trench was approx. 6 ft. 5 in. deep x 28 in. wide x 20 ft. long. The north and south banks of the trench were almost vertical. The employees were not protected from a cave-in hazard by an adequate protective system. NO ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.652(k)(2): When the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: a) On or about 09/06/16, in a trench/excavation where a 10 in. water line was being installed on the south side of the street in front of 964 Kenmore Ave., Buffalo, NY: An employee was crouching down/kneeling in the trench with his head and arms inside the area of a trench box while soaping the bell (on the pipe). The trench box was located in the east end of the trench. The trench was approx. 6 ft. 5 in. deep x 28 in. wide x 20 ft. long. The north and south banks of the trench were almost vertical. The trench box was not installed properly in the trench in that the distance between the bottom of the trench and the bottom of the box was between 3 ft. 3 in. and 3 ft. 5 in. The employee was not protected from a cave-in hazard by an adequate protective system, even when inside the trench box. ABATEMENT DOCUMENTATION REQUIRED
