29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    (a) KB Construction and Excavation at 2331 W. Ridges Blvd, Grand Junction, CO: On and before August 2, 2016, the exposing employer did not ensure that employees were provided protective helmets while working in an excavation where there was a possible danger of head injury from falling objects. Employees worked in an excavation that was approximately 10 feet deep that included loose rock and clods of soil. This condition exposed the employees to the hazard of rocks and clods of soil falling into the excavation and striking the employee's heads.     (b) KB Construction and Excavation at 3005 Purdy Mesa Rd, Whitewater, CO: On and before August 11, 2016, the exposing employer did not ensure that employees were provided protective helmets while working in an excavation where there was a possible danger of head injury from falling objects. Employees worked in an excavation that was approximately 8 feet deep that included loose rock and clods of soil. This condition exposed the employees to the hazard of rocks and clods of soil falling into the excavation and striking the employee's heads.    Abatement Note: The employer must provide each employee with head protection that meets the specifications contained in any of the following consensus standards:  -American National Standards Institute (ANSI) Z89.1-2009, "American National Standard for Industrial Head Protection," incorporated by reference in �1926.6;  -American National Standards Institute (ANSI) Z89.1-2003, "American National Standard for Industrial Head Protection," incorporated by reference in �1926.6; or  -American National Standards Institute (ANSI) Z89.1-1997, "American National Standard for Personnel Protection-Protective Headwear for Industrial Workers-Requirements," incorporated by reference in �1926.6.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a) KB Construction and Excavation at 2331 W. Ridges Blvd, Grand Junction, CO: On and before August 2, 2016, the exposing employer did not ensure that employees working inside an excavation were protected from cave-in hazards, in that employees used a shovel to locate a sewer tie-in next to an excavation face with a near-vertical wall that consisted of previously disturbed soil. The excavation was approximately 10 feet in depth. This condition exposed employees to a crushing hazard by excavation wall cave-in.     (b) KB Construction and Excavation at 3005 Purdy Mesa Rd, Whitewater, CO: On and before August 11, 2016, the exposing employer did not ensure that employees working inside an excavation with near-vertical walls were protected from cave-in hazards, in that employees worked in the excavation approximately 8 feet in depth without using a protective system.  This condition exposed the employee to a crushing hazard caused by excavation wall cave-in.
