OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to workers, in that workers were exposed to excessive heat:  (a) Aprinta production floor: On or about September 8, 2016 and at times prior thereto, employees of Aprinta Group, LLC were exposed to the hazard of excessive ambient heat ( heat index average of 95 degrees Fahrenheit, heat index maximum 104 degrees Fahrenheit) from the solar heat and conveyor ovens for drying printed apparel. The employer had not developed and/or implemented an adequate heat-related illness prevention program.

29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by an ingoing nip point or rotating parts:   (a) Conveyor drying Line 1: On or about September 8, 2016 and at times prior thereto the employer exposed employees to amputation hazards in that employees were allowed to work within three feet of an exposed ingoing nip points on the conveyor.  (b) Conveyor drying Line 2: On or about September 8, 2016 and at times prior thereto the employer exposed employees to amputation hazards in that employees were allowed to work within three feet of an exposed ingoing nip points on the conveyor.  (c) Conveyor drying Line 3: On or about September 8, 2016 and at times prior thereto the employer exposed employees to amputation hazards in that employees were allowed to work within three feet of an exposed ingoing nip points on the conveyor.   (d) Conveyor drying Line 4: On or about September 8, 2016 and at times prior thereto the employer exposed employees to amputation hazards in that employees were allowed to work near an exposed ingoing nip points on the conveyor.   (e) Conveyor drying Line 5: On or about September 8, 2016 and at times prior thereto the employer exposed employees to amputation hazards in that employees were allowed to work within three feet of an exposed ingoing nip points on the conveyor.
