OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: A) Ocean Terminal, on or about September 8, 2016, employees operated 2017 model Nissan Pathfinders, and other vehicles without wearing the seatbelt, exposing employees to a hazard of striking the windshield/steering wheel and other interior parts of the vehicle. One feasible and acceptable abatement method to correct this hazard is: Have employees wear the seatbelts when operating vehicles.

29 CFR 1917.112(a)(1): Vehicle curbs, bull rails, or other effective barriers installed before October 3, 1983, were not at least 6 inches in height at the waterside edges of aprons and bulkheads: A) Apron area around east side of slip, on or about September 7, 2016, wooden curbing along the edge of the apron was less than six (6) inches high and sections of the curbing was damaged, exposing employees to a hazard of driving vehicles off of the apron into the water and drowning.
