29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift.   a) 413 S Sixth St, Fulton, NY, On or about 9/8: The employer failed to have a Competent Person inspect an excavation that measured 15 feet x 8 feet and had a depth of 11 feet to identify hazards associated with failure and collapse due to unstable conditions such as loose soil, encumberances such as trees near its edge and the location of spoil piles found to be less than 2 feet from the excavation edge.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees.  a) 413 S 6th St, Fulton, NY 13069, On or about 9/8/16: The employer failed to provide employees proper egress  while working in a trench that measured 8 feet x 15 feet with a depth of 11 feet and was classified as previously disturbed class C soil.   The  Do It Right Plumbing was previously cited for a serious violation of this occupational safety and health standard or its equivalent standard 29CFR1926.651(c)(2) which was contained in OSHA inspection number 1118161, citation number 1 , item number 1 and was affirmed as a final order on 7/12/16. with respect to a workplace located at 515 Lyons St, Fulton, NY.
