29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.   The employer is failing to report work related injury/illness onto the 300 logs within seven calendar days of receiving information that a recordable injury/illness occurred. This was most recently documented on or about April 4, 2016 at Magna Seating dba Excelsior Springs Seating System located at 301 South McCleary Road, Excelsior Springs, Missouri. The employer failed to record an injury/illness on the OSHA 300 logs and 301 Incident Report within seven days of the reported injury/illness.  a) Assembler Employee #15-031 reported a new injury on April 4, 2016 to which the employee has seen by a specialist. The employee had surgery in September 2015 and was released to full duty from the physician on October 19, 2015. The employee suffered from an MSD from repetitive use of hands.  b) Assembler Employee #15-043 reported a new injury on February, 2016 to which the employee has seen by a specialist. The employee was released from doctor's care and send back to full duty on June 25, 2015. The employee suffered from an MSD from repetitive use of hands.

29 CFR 1904.7(b)(3)(iv): Weekend days, holidays, vacation days or other days off are not included in the total number of days recorded if the employee would not have been able to work on those days because of a work-related injury or illness.  The employer is failing to report loss work days. This was most recently documented on or about May 17, 2016 at Magna Seating dba Excelsior Springs Seating System located at 301 South McCleary Road, Excelsior Springs, Missouri. The employer failed to count the number of calendar days the employee was unable to work as a result of injury or illness, regardless of whether or not the employee was scheduled to work on those days, to include weekend days, holidays, vacation days or other days off.    a) An Assembler Employee log #15-043 had surgery on April 8, 2016 from an injury in June 2015 and was able to return to work on April 10, 2016 per doctors restrictions; no loss days were recorded.

29 CFR 1904.7(b)(4): When an injury or illness involved restricted work or job transfer, the OSHA 300 Log of recordable work-related injuries and illnesses did not have an entry of the total number of restricted or transferred days in the job transfer or restricted work days column.   The employer is failing to classify employee work related injuries or illnesses. This was most recently documented on or about May 17, 2016 at Magna Seating dba Excelsior Springs Seating System located at 301 South McCleary Road, Excelsior Springs, Missouri. The employer failed to record the injury or illness with an estimate of the days the employee will be away from work.  a) An Assembler Employee log #16-019 had a MSD injury to right hand on April 12, 2016, the employer failed to enter the number of restricted or transferred days in the job transfer or restricted work days column  b) An Utility Employee log #16-020 had a slip, trip, and fall injury to both knees on April 12, 2016, the employer failed to enter the number of restricted or transferred days in the job transfer or restricted work days column  c) An Assembler Employee log #16-027 had an injury to right shoulder on May 5, 2016, the employer failed to enter the number of restricted or transferred days in the job transfer or restricted work days column  d) An Assembler Employee log #16-028 had an injury to the left hand on May 11, 2016, the employer failed to enter the number of restricted or transferred days in the job transfer or restricted work days column

29 CFR 1904.29(b)(3): Each recordable injury or illness was not entered on the OSHA 300 Log and/or an incident report (OSHA Form 301 or equivalent) within seven (7) calendar days of receiving information that a recordable injury or illness has occurred:  The employer is failing to ensure that each recordable injury or illness was entered on the OSHA 300 Log within seven (7) calendar days of receiving information that a recordable injury had occurred for the 2016 calendar year. This was most recently documented on May 17, 2016 at Magna Seating dba Excelsior Springs Seating System located at 301 South McCleary Road, Excelsior Springs, Missouri. The employer failed to record an injury or illness within seven (7) calendar days of receiving information that a recordable injury or illness occurred and the employer entered the case on their 300 log eight (8) or more calendar days later.   (a) A Foam Operator Employee log #16-027/026 had a laceration injury to left hand on April 29, 2016. The injury or illness was not entered on the 300 logs when the logs were provided on May 17, 2016. The 300 logs requested on September 14, 2016 contained an injury on April 29, 2016 as a laceration to the pinkie finger.    Magna Seating dba Excelsior Springs Seating System was previously cited a violation of an equivalent Occupational Safety and Health Standard 1904.29(b)(3), which was contained in OSHA inspection number 1110898, citation number 1 item number 1 and was affirmed as a final order on April 7, 2016, with respect to a workplace located at 301 South McCleary Road, Excelsior Springs, Missouri.
