29 CFR 1915.83(c)(3):   When the vessel was supplied with electric shore power, the employer did not determined the safe condition of the vessel's circuits:    a) On or about September 13, 2016, in the floating dry-dock level A damaged area,  the path to ground of the enclosure of a (110 VAC) branch circuit was not continuous and effective. An electrical utility box with receptacles was disconnected from the conduit and with an open ground, exposing employees to electrical shock in the event of a fault.

On or about August 27, 2016,  in the area damaged during a collision at level A of the floating dry-dock, employees were instructed to conduct Class III asbestos work and the employer failed to identify and communicate the presence, location, and quantity of Asbestos Containing Material (ACM) or Presumed Asbestos Containing Material (PACM) to employees before assigning them the task of removing a section of duct covered with Thermal Systems Insulation (TSI), exposing employees to airborne concentrations of asbestos that may have exceeded the Permissible Exposure Limits (PEL).  OR IN THE ALTERNATIVE: 29 CFR 1915.1001(k)(3)(ii): Before work under this standard was performed, the employer failed to notify the employees who will perform such work of the location and quantity of ACM and/or PACM present at the worksite and the precautions to be taken to ensure that airborne asbestos is confined to the area.

29 CFR 1915.1001(n)(6)(i): The building/vessel owner did not maintain written records of the identity, location, and quantity of ACM and PACM for the duration of ownership.    a) On or about September 13, 2016, the employer failed to produce written records of the identity, location and quantity of Asbestos Containing Material and Presumed Asbestos Containing Material in the floating dry dock.  Failure to keep records of the identity, location and quantity of ACM and PACM resulted potential exposure of employees to airborne concentrations of Asbestos exceeding the Permissible Exposure Level while performing work in the wing walls that could disturb ACM or conducting normal operations in areas were ACM has been disturbed by vibration or other type of mechanical force.
