OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to burn hazards from the use of a vacuum cleaner that was not explosion proof: Akzo Nobel, Duluth, GA - Employees in the Belt Expander (BEA) Department were provided and used a regular dry vacuum cleaner for unclogging combustible dust in machine parts.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: Akzo Nobel, Duluth, GA - In the Wet Expander (WE) Department, the water pressure of one of the nozzles of the eye was station was too low and not providing sufficient water to reach the person's eye in the event of a splash. Therefore, the eye wash was not suitable for quick drenching or flushing of the eyes, on or about September 13, 2016.

29 CFR 1910.1200(g)(5): The chemical manufacturer, importer or employer preparing the safety data sheet did not ensure that the information provided accurately reflects the scientific evidence used in making the hazard classification: Akzo Nobel, Duluth, GA - The safety data sheet (SDS) for Expancel 551 WE 40 d36 had a GHS classification of "not a hazardous substance or mixture" when the composition information on ingredients indicated that it contained 1-5 % of isobutene which was flammable and considered hazardous, on or about 9/15/16.
