OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On September 9, 2016, employees were operating a modified powered industrial truck without the manufacturers written approval and/or certification and exposed employees to struck-by hazards. 1. Holes cut in the ends of forks. 2. Clevis attached to holes in the PIT with a sling attached. 3. Daily inspections of forks.
