29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toe board wherever, beneath the open sides: Heaton Corporation, at 1068 Maria Lane, Louisville, CO 80027: On and before September 14, 2016, the exposing employer failed to ensure that each employee on a walking/working surface with an unprotected side or edge 4 feet or more above a lower level we protected from falling by the use of standard railing, or other means of fall protection. Condition resulted in an employee performing window washing falling approximately 9 feet and injuring himself.

29 CFR 1910.26(c)(3)(iii): The ladder base section must be placed with a secure footing. Heaton Corporation, at 1068 Maria Lane, Louisville, CO 80027: On and before September 14, 2016, the exposing employer failed to ensure that employees using a ladder on a surface which was not level, secured the ladder to prevent accidental displacement. Condition resulted in an employee attempting to use a ladder on a 4:12 pitch roof falling from the ladder eventually the roof when the ladder was displaced as he climbed it due to the fact it was not secured.
