29 CFR 1926.1101(d)(3): The employer of employees who were exposed to asbestos hazards did not comply with applicable protective provisions to protect such employees: (a) The Western Sugar Cooperative, at 18317 Highway 144, Fort Morgan, CO: On and preceding 9/16/16, The Western Sugar Cooperative, whose employees were exposed to asbestos hazards, did not comply with applicable protective provisions to protect such employees. Transite, containing twenty percent chrysotile asbestos, was removed on 9/1/16. The work performed by the asbestos contractor using hammers involved a section of paneling on the exterior of the third level of the boilerhouse. This work was Class II asbestos work. Employees of The Western Sugar Cooperative were working on the first level of the boilerhouse during the removal. The method of removal created transite debris. Transite debris was found on the first level of the boilerhouse in the area where employees were working. All debris was not removed until 9/16/16. The Western Sugar Cooperative did not ensure that prompt clean up and disposal of all transite debris created by the contractor took place. This condition exposed employees to an asbestos hazard.

29 CFR 1926.1101(d)(4): The employer of employees working adjacent to regulated areas established by another employer on a multi-employer work-site, did not take steps on a daily basis to ascertain the integrity of the enclosure and/or the effectiveness of the control method relied on by the primary asbestos contractor to assure that asbestos fibers did not migrate to such adjacent areas: (a) The Western Sugar Cooperative, at 18317 Highway 144, Fort Morgan, CO: On 9/1/16, The Western Sugar Cooperative, whose employees were working adjacent to a regulated area established by another employer on a multi-employer work-site, did not take steps on a daily basis to ascertain the integrity of the enclosure and/or the effectiveness of the control method relied on by the primary asbestos contractor to assure that asbestos fibers did not migrate to such adjacent areas. Transite, containing twenty percent chrysotile asbestos, was removed on 9/1/16. The work performed by the asbestos contractor using hammers involved a section of paneling on the exterior of the third level of the boilerhouse. This work was Class II asbestos work. Employees of The Western Sugar Cooperative were working on the first level of the boilerhouse during the removal. The contractor used hammers to "punch out" holes in the transite, which caused the hammer to penetrate through the transite. This action punched holes through the critical barrier and propelled debris onto the third level floor. Transite debris was found on 9/16/16 on the third level floor and the first level of the boilerhouse in the area where employees were working. The Western Sugar Cooperative did not take steps to ascertain the integrity of the enclosure or the effectiveness of control methods. This condition exposed employees to an asbestos hazard.
