29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors:    a) Emerald FX, LLC. Norwalk, Ohio; On or about September 15, 2016, the employer failed to take adequate precautions to prevent the ignition of flammable vapors in that four one gallon plastic containers of Norox MEKP-925H (containing methyl ethyl ketone peroxide), a category 4 liquid sensitive to light, was stored in an open card board box on the ground of the glass shop. Employees were exposed to fire hazards.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    a) Emerald FX LLC. - Norwalk, Ohio; On or about September 15, 2016 the employer failed to provide employees who were required to wear disposable filtering face piece respirators during gel coat operations and grinding of fiberglass with medical evaluations to determine if employees were fit to wear respirators.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:    a) Emerald FX, LLC. Norwalk, Ohio; On or about September 15, 2016 the employer failed to ensure each container of hazardous chemicals in the workplace was labeled. Employees were exposed to eye, skin, and inhalation hazards in that containers containing approximately one gallon of Norox MEKP-925H, methyl ethyl ketone peroxide, located on the Magnum Venus Products spray gun carts were observed without identification labels.     b) Emerald FX, LLC. Norwalk, Ohio; On or about November 12, 2016 the employer failed to ensure each hazardous chemical container in the workplace was labeled. Employees were exposed to eye skin and inhalation hazards in that a open container of acetone located on a work bench was observed without an identification label.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:    a) Emerald FX LLC. Norwalk, Ohio; On or about September 15, 2016 the employer failed to fit test those employees who were required to wear a tight fitting filtering facepiece respirators prior to initial use of the respirator. Employees were exposed to chemical vapors such as, but not limited to, methyl ethyl ketone peroxide, styrene, and acetone while utilizing a spray gun to lay gel coats and paint to fiberglass molds.
