OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees of Arkansas Granite and Marble, LLC exposed employees to ejection and crushed by hazards while allowing them forklifts without the use of seat belts.     On or about September 14, 2016 and times prior thereto, at the worksite located at or near 1916 W. Sunset Avenue, Suite C in Springdale, Arkansas, employee(s) were observed operating the Yale, propane powered forklift to move granite slabs without wearing a seatbelt.  In the event of a forklift over-turning, this condition exposed employees to ejection and crushed by hazards.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:     At or about September 14, 2016 and times prior thereto, at the worksite located at or near 1916 West Sunset Avenue, Suite C in Springdale, Arkansas, employees in the fabrication shop onsite and employees out in the field were required to wear a 3M half-face respirators or N-95 dust masks. The employer had not developed or implemented a written respiratory program. This exposed employees to inhalation hazards.
