29 CFR 1926.1101(m)(2)(i)(B): The employer did not make a medical examination available when the employee was assigned to an area where exposure to asbestos may be at or above the permissible exposure limit for 30 or more days per year, or engage in Class I, II, or III work for a combined total of 30 or more days per year, a medical examination must be given within 10 working days following the thirtieth day of exposure: a) On the 7th floor of the Penn Rose Building, on or about September 16, 2016 - The employer failed to make a medical examination available to a Laborer within 10 working days after the Laborer completed 30 days of Class I, II, or III asbestos work in 2016.
