Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed-by a forklift in the event of a tip over:     On or about September 15, 2016, at the facility where an employee was exposed to crushed-by hazards while operating a Doosan brand forklift without wearing a seatbelt.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:     On or about September 15, 2016, and at times prior thereto, when employees in the facility were required to operate forklifts while moving material without having been trained and evaluated to ensure they could do so safely.
