The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures.   a.  On or about September 10, 2016 at the Kroger Distribution Center located at 2000 Nutter Farms Lane, Delaware, Ohio, the employer did not ensure employees wore proper footwear to protect them from falling and rolling objects while handling boxes and operating/working near moving order selectors, thereby exposing the employees to struck-by and/or crushing injuries.
