29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. 29 CFR 1926.451(g)(2): Effective September 2, 1997, the employer shall have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling supported scaffolds. Employers are required to provide fall protection for employees erecting or dismantling supported scaffolds where the installation and use of such protection is feasible and does not create a greater hazard: a. On or about September 15, 2016, the employer did not determine the feasibility and safety of providing fall protection and ensure the use of fall protection for an employee erecting a Waco fabricated frame scaffold, thereby exposing the employee to a fall hazard of approximately 14 feet.
