29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: Kitchen: A protective apron was not provided and worn by workers changing out hot oil in the food fryer. On 9-7-16 An employee suffered skin burns during the process of cleaning out dirty oil from the fryer. The hot oil splashed on an employee when the heating element accidently fell into the hot oil.

29 CFR 1910.38(a): The employer did not establish a written emergency evacuation plan for employees expected to evacuate in the event of a fire or other emergency. Bakery, Restaurant, and Kitchen Areas: An emergency action plan was not developed and implemented describing evacuation procedures in the event of fire or other emergency situations. A written program shall include the following information; 1. Procedures for reporting a fire or other emergency; 2. Procedures for emergency evacuation, including type of evacuation and exit route assignments; 3. Procedures to be followed by employees who remain to operate critical operations before they evacuate; 4. Procedures to account for all by employees after evacuation; 5. Procedures to be followed by employees performing rescue or medical duties; and 6. The name or job title of every employee who may be contacted by employees for more information about the plan or an explanation of their duties under the plan.
