29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   (a) Master Roofing, at 11500 Peoria St., Commerce City, CO 80022:  On and before September 20, 2016, the exposing employer failed to develop, implement, and maintain a written hazard communication program which at least describes how labels and other forms of warning, safety data sheets, and employee information and training will be met.  The employer directed employees to use portable circular saws to cut cement roofing tiles without establishing a hazard communication program.  Conditions exposed employees to silica and chemical hazards.  Abatement note:  1929 CFR 1926.59 provides that the requirements applicable to construction work under this section are identical to those set forth in 1910.1200.

29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift:  (a)  Master Roofing, at 11500 Peoria St., Commerce City, CO 80022:  On and before September 20, 2016, the exposing employer failed to maintain copies of the required safety data sheets in the workplace for each hazardous chemical.   The employer directed employees to use portable circular saws to cut cement roofing tiles without providing safety data sheets concerning the hazards of working with silica and other chemicals.  Conditions exposed employees to silica and chemical hazards.  Abatement note:  1929 CFR 1926.59 provides that the requirements applicable to construction work under this section are identical to those set forth in 1910.1200.

The employer directed employees to use portable circular saws to cut cement roofing tiles without providing effective information and training about silica and chemical hazards.  Conditions exposed employees to silica and chemical hazards.  Abatement note:  1929 CFR 1926.59 provides that the requirements applicable to construction work under this section are identical to those set forth in 1910.1200.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system:  (a)  Master Roofing, at 11500 Peoria St., Commerce City, CO 80022:  On and before September 20, 2016, the exposing employer failed to ensure that each employee engaged in roofing a single family home with ranch-style design, and with a roof with a 6 on 12 pitch roof, was protected from failing.  The employer allowed employees to work without the use of a guardrail system, safety net system, or personal fall arrest system.  Condition exposed employees performing roofing work to fall hazards of approximately 11 feet.

The employer failed to identify and evaluate the respiratory hazards in the workplace.  Conditions exposed employees to respiratory hazards.     Abatement note:  1929 CFR 1926.103 provides that the requirements applicable to construction work under this section are identical to those set forth in 1910.134.
