29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) West Ave & 36th St., Ocean City, NJ: On or about January 17, 2017, two Masters Builders Inc. employees were conducting framing work on a new construction three story residence. One employee was using the 3rd floor wall top plate as his walking working surface while a second was working from an unguarded second floor deck. he employees were not using any form of fall protection and were thus exposed to a fall hazard of greater than 20 feet to the ground below.

The ladder used to access the upper level working surfaces was found to be damaged. The employer did not ensure that the ladder had been inspected prior to use and taken out of service when visible defects affected its safe use. .

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. a) West Ave & 36th St., Ocean City, NJ: On or about January 17, 2017, Masters Builders Inc. employees were conducting framing work on a new construction three story residence. The aluminum extension ladder used to access the upper level working surfaces was found to be damaged. The bottom rung of the ladder was completely broken and the rails bent and twisted outward at the base. .
